In many of our cases, there are repercussions in both States, such as a DUI arrest where a person is charged in South Carolina but lives in North Carolina. While out-of-state lawyers may think they understand other State’s laws, they may not licensed to practice and are often wrong. Attorney Robert J. Even though we are connected by the interstate, there are vastly different laws that apply. For example, in personal injury cases, NC still recognizes “contributory negligence” where any recovery is completely barred if you are “at fault” in any way. However, SC courts use the different standard of “comparative negligence” where financial recovery is reduced by up to 50% before a claim is dismissed. This distinction is critical in personal injury cases. To illustrate, if you were to get into an accident that was maybe 10% your fault in Indian Land, SC, you would still be entitled to a recover against the negligent party but reduced by that percentage.  On the other hand, if you got into that same accident in Ballantyne, NC, you would likely be barred from recovering anything at all, no matter how seriously injured or even if killed. Another critical difference is whether automobile policies can be “stacked” to afford greater coverage where the “at fault” driver does not have enough liability coverage or none at all. Better make sure a potential lawyer knows these distinctions and can represent you and your family in court.

In DUI and DWI cases, the laws again are very different in critical respects. In South Carolina, a person charged is entitled to a jury trial, and there will be significant video evidence that will show what happened during the arrest and breath testing. In North Carolina, by contrast, there is limited video, and your first trial is held before a judge only. There are also significant differences in what the law requires of police as they make the arrest and process a defendant. If convicted, there are separate punishments in both States. In South Carolina, you will lose your license for six (6) months. In North Carolina, your driving privileges will be revoked for one (1) year. In order to give advice, a lawyer is required to be licensed to practice law. Even if the advice given improperly turns out to be correct, that lawyer still cannot represent you or appear in court on your behalf. Better to make certain any lawyer you’re considering is actually able to give you legal advice and represent you and your family properly.
