Last winter, the South Carolina Highway Patrol reported that a man was killed in a single-car accident when he lost control of his truck and crashed alongHarrisburg RoadnearMcAlpine Circle.
The driver and the passenger were taken to the hospital where the passenger was pronounced dead. The troopers did not charge the driver, and there are no reports of foul play.
Although criminal charges were not pressed in this matter; that does not mean civil charges are not applicable. There are a few questions that must be asked when you or a loved one has been injured in a car wreck: (1) Was the driver was negligent?; (2) If so, was the negligence the proximate (or legal) cause of the prospective Plaintiff’s injuries?; and, (3) what amount, if any, is Plaintiff or Plaintiff’s family entitled to recover from the Defendant?
