Multi-Car Crash in South Park Kills Elderly Charlotte Man

A multi-car crash in South Park has left one person dead Thursday afternoon.

According to authorities, the crash happened around 2:30 p.m. at the intersection of Simsbury Road and Fairview Road just west of Charlotte Country Day School.

The fatal crash occurred when a 75-year-old Charlotte man plowed his 2008 Acura into the rear of a BMW that was stopped at a stop sign on Simsbury Road waiting to turn right onto Fairview Road.

After hitting the BMW, the man’s Acura continued across Fairview, coming to a stop after crashing into a tree, killing him on the scene.

The woman driver of the BMW was treated at the scene of the wreck by Medics but did not need to be transported to the hospital.

Man Charged with DUI after Fatal Lancaster Collision

A Heath Springs, S.C. man was driving his SUV down the 1600 block of Camp Creek Road in Lancaster County last December when he struck a tree killing one and injuring another passenger who was air-lifted to Charlotte.

The South Carolina Highway Patrol charged the driver with possession of a controlled substance and Felony DUI after the fatal crash.  It was reported by Police that the man swerved his vehicle to the right overcorrecting to the left striking a tree.

A person will be charged with a Felony DUI if the following factors are present: (1) driving a vehicle under the influence of alcohol, drugs, or both; (2) if, while operating the vehicle under the influence, the person causes great bodily injury or death; (3) to a person other than himself (this includes a passenger, pedestrian, and/or another driver).

What is SC’s Felony DUI Law?

In South Carolina, since 1983,  it has been a felony to cause death or great bodily harm to another person while operating a vehicle under the influence of drugs or alcohol.
This is classified as a Felony DUI under S.C. Code § 56-5-2945.  If a victim dies as a result of a driver operating a motor vehicle under the influence of drugs or alcohol, the penalty is a mandatory fine of $10,000 to $25,000 and mandatory imprisonment of 1 to 25 years. Additionally, the statute states, that no part of the mandatory sentence may be suspended.
Three elements are required for a charge of Felony DUI to be distributed: (1) the actor drives a vehicle while under the influence of alcohol or drugs; (2) the actor does an act forbidden by law or neglects a duty imposed by law; and (3) the act or neglect proximately causes great bodily harm or death to another person. State v. Dantonio, 376 S.C. 594 (2008).
Proximate cause is outlined in Dantonio, which states that a defendant’s act need not be the sole cause of the victim’s death to sustain a conviction for Felony DUI, provided it is a proximate cause actually contributing to the death.  Id.

Clover Teen Charged with Three Counts of Felony DUI

Clover teen is currently awaiting trial for an accident that occurred in late August of this year.

Accordingly, the 19-year-old is being charged with three counts of felony DUI; one of those DUI’s resulting in a death, and the other two resulting in great bodily injury, and driving under a suspended license. Sadly, this was not the first time the defendant has been charged with a DUI.

The police report states that the defendant was driving in his 1996 Infinity, when his vehicle swerved to the right side of the road, hit a tree, and subsequently flipped over onto the roof of the car.

All four people in the vehicle were ejected from the car at the time of the accident. One passenger was killed on impact. The driver/defendant and another passenger were taken by the paramedics to Piedmont Medical Center, and another was flown to Carolina’s Medical, via helicopter.

The police report states no one was wearing a seat belt.

Rock Hill Man Dies When Car Crashes

A 48-year-old Rock Hill resident died yesterday when his car collided into a tree just south of Rock Hill.

The accident took place on SC 901, a few miles from Rock Hill. According to the South Carolina  Police Department’s investigation reveals the victim was driving hid 1984 Chevy Pick up truck when the truck drove off the right hand side of the road and aggressively struck a tree.

The victim lost his life on scene, due to blunt force, i.e the impact tree hitting the tree.

The victim was reported to have been wearing his seatbelt.

For the past six years, Rock Hill drivers have begun to drive more cautiously. A census revealed that from 2006-2012, the South Carolina average for car accidents aggressively exceeds the Rock Hill average.

Rock Hill Car Accident Kills One and Injures Another

Two college students were involved in a serious accident during Spring Break of this year that left one teen dead, and another seriously injured.

According to the South Carolina Highway Patrol report, the accident occurred on a Friday night, around 11:40 a.m. The two teens were travelling on Interstate 77 when they crossed over the North Carolina state line and into South Carolina. The collision happened one mile from exit 82, the first Rock Hill exit.

A preliminary investigative report states that the teens were driving a 2005 Mazda sedan, that somehow made its way off the right hand side of the road, striking a tree.

Both of the teens were taken to the hospital immediately, but only one teen was released. Unfortunately, the other teen lost his life in this tragic accident. The two boys were friends and classmates at Ohio Wesleyan University. The fatal victim will be greatly missed according to fellow students and professors.
