The rate of traffic deaths that happen after dark are three times higher than those that occur during the day. Night driving presents an entirely new set of hazards that many drivers may not be aware of or don’t know effective ways to deal with them. The most obvious reason for this is the fact that it is dark. In fact, an alarming ninety percent of a driver’s reaction depends on vision, which is severely limited at night. After sundown, depth perception, peripheral vision, and color recognition are all compromised. The driver and the passenger were taken to the hospital where the passenger was pronounced dead. The troopers did not charge the driver, and there are no reports of foul play.
Although criminal charges were not pressed in this matter; that does not mean civil charges are not applicable. There are a few questions that must be asked when you or a loved one has been injured in a car wreck: (1) Was the driver was negligent?; (2) If so, was the negligence the proximate (or legal) cause of the prospective Plaintiff’s injuries?; and, (3) what amount, if any, is Plaintiff or Plaintiff’s family entitled to recover from the Defendant?
