Fatal Crash Involving Pedestrian-Charlotte Wrongful Death Attorneys

Charlotte-Mecklenburg Police are investigating a fatal crash involving a pedestrian that occurred on Friday on Steel Creek Road. According to investigators, a man crossing Steele Creek Road near the intersection of Branch Bend Lane was struck by a 2007 Kia.

A man was driving the Kia with three passengers inside at the time of the crash.  The pedestrian was transported to Carolinas Medical Center, but died Saturday Morning.

As of yet, no charges have been filed against the male driver.

Supreme Court Refuses to Hear Tobacco Company Wrongful Death Appeal–Charlotte Wrongful Death Attorneys

The U.S. Supreme Court will not hear an appeal in a wrongful death case where a jury ordered R.J. Reynolds Tobacco Co. to pay $28.3 million in damages to a woman whose husband died of lung cancer after decades of smoking cigarettes.

The Winston-Salem tobacco manufacturer’s appeal is based on an alleged violation of its right to due process since the state court precluded litigation of certain issues that had not been necessarily decided during the so called “Engle” cases from which the Reynolds’ case stemmed.

The Engle progeny of cases relate back to the 1994 class-action suit by which the Florida Supreme Court allowed cases of sick Floridians to move forward individually and upheld jury findings that smoking causes disease, that nicotine is addictive, that cigarettes are defective and dangerous, ant that tobacco companies concealed the health effects of smoking.

Woman Crashes Into Bus Ejecting Toddler Son From Car–Charlotte Accident Attorneys

A Charlotte woman who was speeding and apparently on drugs crashed into a CATS bus causing her 2-year-old to be ejected from her car Friday afternoon in southwest Charlotte.

The crash happened on South Tryon near Yorkmont Road at approximately 3:30 p.m.  The woman driver was traveling northbound on South Tryon Street when her car sideswiped into a 2001 Chrysler Concorde.   She then slammed into a CATS bus and her 2-year-old son was ejected from the car.

South Tryon was blocked on both sides for 2 hours while crews worked to clear the scene. The 2-year-old was rushed to Carolinas Medical Center with serious injuries.  The woman was also transported to the hospital with non-life threatening injuries.

Investigators of the crash in a preliminary investigation found that the child was not properly restrained in the child seat.

The woman driver has been arrested and charged with DWI, no operators license, reckless driving, failure to reduce speed, child restrain violation, and two counts of felony serious injury by vehicle.

Single-Car Accident Kills One

The South Carolina Highway Patrol reports that a man was killed last month in a single-car accident, in which he was the passenger. The location of the accident was York, South Carolina.

The Troopers reported that the driver suddenly lost control of the truck and crashed it along Harrisburg Road, near McAlpine Circle. Both the driver and passenger were taken to the nearby hospital, but only the driver recovered. The passenger/victim sadly lost his life.

Currently, troopers are still investigating the accident.

Police Tases Teen To Death-Charlotte Wrongful Death Attorneys

Taser International Inc. has been ordered to pay $10 million to the Charlotte family of a teenager who died after being shocked by a Charlotte police officer.

The jury in a federal court retured the verdict for the wrongful death of 17-year-old Darryl Turner,  the teen who collapsed and died on the floor of a Food Lion store in northeast Charlotte in March 2008.  The teen was arguing with his manager when the policeman used the taser on the teen, striking him in the chest.   The teenager went into cardiac arrest.

Lawyers representing the family of the deceased teenager convinced jury members that the manufacturer knew, but failed to warn customers that the product could cause heart problems if administered near the heart.  The attorneys for Taser International, on the other hand, were not as convincing when they argued that the teen had heart problems that contributed to his death.
