A South Carolina resident, son, schoolmate, and friend lost his life when he was leaving his father’s gravesite.The son was apparently speeding after the visit in his 1998 Mercedes convertible, when he lost control and drove off the right side of the road. His convertible incidentally hit a drain pipe, flipping the car over on the 15-year-old driver.
It was reported that the teen died on impact around 8:00 p.m. two Fridays ago. The victim was the only person in the vehicle at the time of collision. A friend was however, driving behind him. Speed has subsequently been listed as a contributing factor according to the coroner’s report.

This past weekend was a dangerous one for drivers of secondary and rural roads, according to the SCDOT reports. Accordingly, five people were killed from car collisions while using South Carolina’s rural and back roads for their travels.
One individual who lost his life was a marine stationed in Georgia and headed back to the base from a long weekend in South Carolina.
S.C. Highway Patrol Cpl. states that the marine appeared to have been traveling south on Friendship Road at a high rate of speed when his GMC truck went off the road. The marine veered back and forth several times attempting to stabilize the vehicle before the truck left the right side of the road and struck a tree before going airborne, and eventually overturning, taking the marine’s life. The Coroner’s report states that he died from massive head and neck trauma due to the collision, which occurred sometime after 6:00 p.m. on Sunday.
Moreover, it has been released that the marine was not wearing his seat belt, and speed was a contributing factor to the collision.

One person was injured Monday morning when a logging truck overturned in the front yard of a Lancaster SC home.
The accident occured on E. Doc Garris Road, just southeast of the Kirk Air Base. The truck, blocking part of a driveway, rolled over in the front yard of a home.
According to local officials, only one person was injured and was transported to a nearby hospital.

In the recent South Carolina Supreme Court case, Graves v. CAS, the Court took the opportunity to clarify the law regarding expert testimony and design defect claims.
In this case, parents claim that the failure of a neonatal monitor to alarm caused the death of their infant child. The monitor was designed to alarm if the heartbeat of the child became too slow as a way of preventing death due to SIDS or infant apnea. The plaintiffs claimed, and had the expert testimony of a neonatologist to support the notion, that they would have been able to resuscitate the child had the alarm sounded.
However, the controversy was the basis of their claimed design defect. In South Carolina, plaintiffs to prove a design defect claim must show that the design was defective and that there is an alternative design that would have prevented the injury. Since a neonatal monitor is a complicated product that jury members are unlikely to understand, expert testimony is required for such a design defect claim to survive summary judgment.
The expert testimony in this case went principally to the nature of the software, and that testimony would have been acceptable, but the experts in “reasoning to the best inference” (which is by itself acceptable) failed to exclude the possibility that the alarm actually did go off. The experts assumed that since the plaintiffs said the alarm did not go off, the alarm couldn’t have gone off because no one would have been able to sleep through the alarm and the parents would not have let their baby die.
This is a worrying result as sleeping through alarms presumably isn’t the purview of computer experts and is presumably something that juries can easily understand.

In the recent South Carolina Supreme Court decision,Weston v. Kim’s Dollar Store, the Court gave a textual read to the federal statute expressly preempting certain drug and medical device torts. In that case, a young lady bought a pair of color contacts without a prescription from Kim’s Dollar Store and shortly thereafter lost sight in one eye. Blindness from a color contact; can you imagine?
The statute in question is as follows:
“[N]o State or political subdivision of a State may establish or continue with respect to a device intended for human use any requirement—
(1) which is different from, or in addition to, any requirement applicable under this chapter to the device, and
(2) which relates to the safety or effectiveness of the device or to any other matter included in a requirement applicable to the device under this chapter.
The Court basically ruled that the words stand for themselves, that any common law rule of tort that would be different from or would add to the federal drug laws is preempted, and not much further. The application of this rule was sent down to the trial court.

At least three motorists were rescued on Monday morning after being trapped in their vehicles during the massive flooding that occurred in Lancaster and surrounding counties. The rescues took place on Langley Road near S.C. 9, Cimarron Road and Hershel Plyler Road.
High water in Lancaster is placing motorists at a higher risk of being involved in an accident or being trapped in their vehicles.
Areas located near Lancaster and Chesterfield counties have received over seven inches of rain and several flood warnings have also been issued. With more rain on the way, the Sheriff’s Office continues to warn motorists of trouble spots prone to flooding.
