EMT Killed in Rock Hill in Tractor -Trailer Accident

An EMT was killed last Tuesday morning, where a tractor-trailer and ambulance were involved in a deadly crash in front of the Carolinas Medical Center-Union.

The tractor-trailer was being driven by a man from Madison, NC who was traveling westbound on Independence Boulevard, when the tractor collided with an ambulance that was pulling abruptly into the roadway from the hospital parking lot.

The driver of the ambulance suffered some minor injuries, but has since been stabilized at the hospital. Moreover, it has since been confirmed that the EMT passenger in the ambulance, was in fact killed in the crash.

Fortunately for the driver of the tractor-trailer, he suffered no serious injury from the crash. Moreover, there were no patients in the ambulance yet, as it was en route to the hospital to pick up a patient at the time of the collision.

Wrongful death cases are multifaceted. A thorough investigation must be started almost immediately in order to preserve critical evidence in a fatality. Autopsies are almost always necessary to determine the exact mechanism and cause of death. There is the issue of whether the decedent died instantly or may have a “survival action.” The medical reports can be very confusing as they include external anatomy examination, internal organ examination, microscopic review of tissues, as well as fluid toxicology testing for drugs, alcohol, or disease.

In wrongful death cases, there are potentially two types of benefits. The first is a “survival action” where the decedent lives for even an instant before death. This is where witnesses at the scene or autopsy results are vital. If proven, the decedent’s estate is entitled to medical bills, funeral expenses, and pain and suffering. The second benefit, which does not go through the estate, is for loss of support, services, and companionship, and goes directly to family members.

No matter which type of benefit you may qualify for, please call the wrongful death attorneys at Reeves, Aiken, and Hightower, LLP to help you evaulate your case. Studies conducted in 2010 revealed that 4,280 pedestrians were killed and an estimated 70,000 were injured in traffic crashes in the U.S.  On average, a pedestrian was killed every 2 hours and injured every eight minutes in traffic collisions.  Road safety is a responsibility for all road users, drivers and pedestrians alike.  However, pedestrians can take extra precautions to ensure that the inherent vulnerability of walking around motor vehicles can be mitigated as much as possible.  If you are a pedestrian traveler, be sure stay visible to drivers by wearing bight and/or reflective clothing and carrying a flashlight.  Walk and stand clear of buses, hedges, parked vehicles, and other hazards before crossing.  Always walk on the sidewalk or on the road facing traffic if there is no sidewalk.  If possible, cross streets at marked crosswalks and intersections and make eye contact with drivers you cross in front of.  When crossing, look left, right, and then left again before crossing the street.

Supreme Court Refuses to Hear Tobacco Company Wrongful Death Appeal–Charlotte Wrongful Death Attorneys

The U.S. Supreme Court will not hear an appeal in a wrongful death case where a jury ordered R.J. Reynolds Tobacco Co. to pay $28.3 million in damages to a woman whose husband died of lung cancer after decades of smoking cigarettes.

The Winston-Salem tobacco manufacturer’s appeal is based on an alleged violation of its right to due process since the state court precluded litigation of certain issues that had not been necessarily decided during the so called “Engle” cases from which the Reynolds’ case stemmed.

The Engle progeny of cases relate back to the 1994 class-action suit by which the Florida Supreme Court allowed cases of sick Floridians to move forward individually and upheld jury findings that smoking causes disease, that nicotine is addictive, that cigarettes are defective and dangerous, ant that tobacco companies concealed the health effects of smoking.
