The family of a 39-year-old man with schizophrenia who died after a struggle with Greenville police has sued the city, six police officers and Chief Terri Wilfong, alleging wrongful death “for use of excessive force by deploying multiple Tasers over an extended time and improper physical restraint technique,” according to federal court records.
The suit filed in U.S. District Court alleges wrongful death against officers who were called to the Augusta Street home of Andrew Torres in August 2012 to carry out a probate judge’s order sought by his family to take Torres to the hospital. It also alleges that Torres’ constitutional rights were violated and that Wilfong “failed to promulgate adequate policies and failed to supervise her subordinates who use unconstitutional levels of force in taking mentally ill citizens into protective custody.”
Defendants deny the allegations. According to police, Torres refused to cooperate and scuffled with officers at the time of the incident.
The Greenville County Coroner report indicates that Torres died of cardiac arrhythmia as a result of the use of Tasers, the physical strain of tussling with police, and having an enlarged heart.
The case has been ordered into mediation to be completed by February 4 of next year. The suit seeks both compensatory and punitive damages.

On September 4th around 5:30 p.m., Jeffrey Scott Bailey, a 20-year-old Lawndale resident, was transported by ambulance to Carolinas Medical Center following a two-car crash on N.C. 18.
According to Trooper Brian Theis of the North Carolina Highway Patrol, a Ford F-150 rear-ended the Pontiac Firebird in which Bailey was riding. The possible danger arose where Bailey was sitting in the back seat of the small Firebird when it was struck from behind by the F-150.
Theis reported that he was not aware of any life threatening injuries resulting from the crash. Several others involved in the crash were transported to Cleveland Regional Medical Center for treatment.Members of the Fallston Fire Department said that Bailey was pinned inside the car after the crash. Three Firetrucks responded to the crash along with Cleveland County EMS and the Cleveland County Sheriff’s Office.
As it stands, there is no report of alcohol being involved in the crash. Theis says that there will only be a failure to reduce speed charge.

An airplane pilot wrecked not his plane, but an airport car in Anderson, South Carolina last week in an accident involving a tractor-trailer. Not an airline pilot, he apparently was flying a private jet.
The car belonged to the Anderson County Regional Airport and existed for the use of individuals, like this airplane pilot, who fly into the airport. The South Carolina Highway Patrol has not provided much information about the accident.
The collision happened on S.C. 28 Bypass near the Sonic Drive-In in Anderson. The pilot hit the rear of a tractor-trailer truck, which had stopped due to a fender-bender in front of it. There is no indication that the truck driver was injured in the accident. Neither were the pilot nor his two children, who were sitting in the back seat. The pilot’s wife, sitting in the passenger seat, required an X-ray to disprove injury.
The wreck will not deprive the airport of a car. A second car will be available, and insurance will replace the wrecked auto soon.

A single car accident took place this past Sunday, claiming the life of a Third Infantry Division Soldier.
Spc. Nolan W. Mincey, 22, of St. George, S.C., was assigned to the 1st Heavy Brigade Combat Team, 3rd ID, as a combat engineer. He had been a member of the Army since October 2008, and arrived at Fort Stewart in 2011 where he stayed until this fatality. He was lucky enough to only have one deployment, and was subsequently awarded the Combat Action Badge.
The collision occurred on Friendship Road near St. George, where Mincey’s car somehow lost control and drove off the road, only to strike a tree around 6:10 p.m. The details of the Soldier’s cause of death, and what if any where the contributing factors is still a mystery.
Thus, the accident is under investigation.

Today is a day that will be forever remembered in America’s history. This day marks the 11th anniversary of the tragic events that took place on September 11, 2001, when the Unites States was attacked by terrorists.
Memorials and ceremonies have been taking place all day, in every state of this great Nation; but it is particularly important to remember that friends and families in New York City still need our support, even after a decade!
In the past, thousands of people would gather around the World Trade Center and what was known as our ” Twin Towers,” to read aloud the 3,000 plus names of the victims who were killed in the worst terrorist attack that this Nation has ever known.
It is disheartening, but after 10 year anniversary, many people feel that the mourning period for this mass devastation should come to an end, and we as a Nation should move on, but not forget. That being said, many elected officials were not speaking publicly for the first time since 9-11, and many families and cities altogether cancelled their “remembrance memorials.”
However, for others, these “ceremonies are just as tough as they were after the first year,” states Marisol Torres as she tightly grasped a photograph of her cousin who lost her life 11 years ago today. “I wish I could say it gets easier, but it doesn’t,” said Torres. “I think you learn to live with your grief so in some sense it gets easier but you sort of learn to carry that around with you.”
No matter how you are dealing with the grief of the events that happened 11 years ago today, we at Reeves, Aiken, and Hightower, LLP want to extend our sympathy out to those who are suffering both publicly and privately, to those who have lost family members or loved ones, and to those who are still grieving for this Nation and it’s loss.
In remembrance of the victims of September 11th, 2001.
