Person Drowns While Rescuing a Double Amputee- SC Attorney

Force Majeure clauses ( or Acts of God Clauses) are used in contracts to prevent someone from suffering if an intervening cause interrupts the person’s performance of the contract.

However, how can one protect themselves from natural disasters in other manners, particularly; how would one deal with rescuing a double amputee during a horrific thunderstorm turned deadly.

Accordingly, a  pontoon boat capsized on Lake Moultrie in South Carolina  this past Sunday, claiming the life of a still unidentified person. There were 6 people who were thrown from the boat, but only one fatality has been confirmed. The other 5 victims swam safely to the nearest dam and hold on until the Rescue Team arrived.

Sadly, the unidentified person drowned while attempting to rescue a double amputee who was a passenger of the pontoon boat, and also thrown from the ship during the storm.

According to Senior Meteorologist Kristina Pydynowski, she had given the locals a warning as she announced that “damaging winds and downpours are the greatest dangers from the powerful thunderstorms targeting far southeastern Virginia and the eastern Carolinas.”

It is a tragedy that one person heard the warning, but still mounted the pontoon boat, only to later drown while attempting to rescue one who could not rescue themselves.

Daughter Badly Injuring in Boating Accident- SC Accident Attorney

The Waccanaw River in South Carolina has claimed the life of one, and has seriously disrupted the life of another.Apparently this last Saturday, there was an accident involving a boat, a tree, and a couple of college kids.

According to the Department of Natural Resources Investigators, the investigation is still underway and will take weeks to figure out what exactly happened. All that is being released thus far is that the boat the three college kids were on collided with some trees sometime shortly before 7:00 p.m. Thereafter, one of the students was pronounced dead on scene, and the other two were taken to the hospital.

One father’s daughter was on that boat, and was still in the Intensive Care Unit at Grand Strand Regional Medical Center as of Monday night, where she remained unconscious until 9:00 p.m., where she thereafter opened her eyes 6-7 times that night and into the next morning.

What is really the heart of the problem, as stated by the girl’s father is “with South Carolina’s boating laws, because it is not required to have insurance in order to own a boat. ” His daughter was transported to the hospital via helicopter, and now the weight of the bills have fallen onto the shoulders of the father, as though his punishment is not already grave enough.

Wrongful Death in Mecklenburg County

Sadly, there was an industrial accident that took the life of one man, and injured a second at Parker Hannifin last Tuesday.

The accident occurred in the Southwest region of Mecklenburg County at 9225 Forsyth Park Drive, off Westinghouse Boulevard. Paramedics were called to the scene and arrived around 4:30 p.m. on Tuesday.

The investigation revealed that the two men involved in the accident were picking up cabinets from Parker Hannifin, when suddenly, the materials feel atop them and engulfed their bodies.

The name of the man who lost his life has not yet been released, but we have been informed that he was a private contractor who drove trucks for Landstar. Unfortunately, the weight of the cabinets was too much for the gentleman, and he was pronounced dead on scene when the Paramedics arrived.

However, the other injured man was taken to Carolinas Medical Center in Pineville, and is expected to be released without “life threatening” injuries.

There is currently some discrepancy as to who has jurisdiction over this accident. Particularly, the Department of Labor is checking to see if they are entitled to obtain jurisdiction over the wrongful death suit.

Gastonia Truck Spills Beer- Gastonia Accident Attorney

The North Carolina Interstate 85 was filled with 21 tons of beer August 18th, when a tractor-trailer truck collided with another vehicle, spilling the tons of Hoppy Libations across the roadways.

The location of the car accident was on I-85 North in Gastonia, NC, and occurred on or about 5:00 p.m. Traffic reports were inflated drastically due to the accident, especially during the ” 5:00 o’clock traffic rush.”

The cause of the accident has been investigated, and it appears as though during a rain storm, the driver of the car spun out of control, slamming into the driver of the tractor-trailer. It was truck driver Jessie Cabiness’ 40th birthday on the date of the accident.

Luckily, there were no injuries that arose from the car accident, aside from the fact that the shipping company is taking the entire shipment of beer to the dump.

Police said the car driver was cited for driving unsafe for the conditions.

Children Below Age 4 Most Susceptible to Injury- SC Accident Attorney

In a recent study conducted by SC Budget and Control Board, found that South Carolina is ranked 42nd out 50 for Child Safety . Essentially, there are only 8 states below SC that have a higher death rate for children within the infant/toddler range of 0-4.

Pursuant to the report, South Carolina’s four  leading causes of death for children ages 0-4, were the following, in their respective order: automobile accidents, suffocation/strangulation, drownings, and lastly, fire/smoke.

Although car accidents still remain the number one, unintentional cause of death to children within the aforementioned age range, these numbers have been on the decline since 2003. The report attributes this decrease to stricter laws governing safety belts/seats for children, as well as public awareness about child safety.

There were 18 deaths reported due to suffocation/strangulation. Of these, 9 of the accidents were due to “roll over or overlay,” which is what occurs when the child is sleeping with the adult, and the adult rolls over onto the child during the night’s rest.  The other half of were due to strangulation, a heinous crime to commit intentionally upon anyone, especially a child.

When there is an unintentional drowning, it is common for the accident to occur in a pond or creek outside the parents’ home. The number one issue with this topic is that parents often times believe that their children are safe if they have a life vest on, and neglect to exercise adult supervision. It is important to remember that a life vest or older child is never a sufficient replacement for adult supervision, especially when a young child is near the water’s edge.

Lastly, fire and smoke is the fourth leading cause of unintentional deaths in SC. For the past 10 years, about 10 children a year die due to fire, or the smoke that arose thereafter. Public awareness of this type of emergency situation should contribute to the decline of these residential type accidents.
